Welcome to Incoguard, a unique application provided by KeyForce ("Company," "we," "us," or "our"). These Terms of Use ("Terms") form a legally binding agreement between you, the user, and us, and govern your access to and use of the Incoguard application ("App"). By downloading, accessing, or using our App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you are not authorized to access or use our App.
1. License to Use the App
We grant you a non-transferable, non-exclusive, revocable, limited license to download, install, and use the App for your personal, non-commercial purposes, strictly in accordance with these Terms. This license is for the sole purpose of enabling you to use the App as provided by us, in the manner permitted by these Terms. You agree not to use the App for any other purpose, including commercial purposes, without obtaining our prior written consent.
2. User Responsibilities
As a user of Incoguard, you are responsible for your actions within the App. You agree to comply with all applicable laws, rules, and regulations while using the App. You also agree to not engage in any of the following prohibited activities:
The App and all rights therein, including, without limitation, all copyrights, trademarks, trade secrets, patents, and other intellectual property rights are owned by or licensed to KeyForce. Your use of the App does not grant you any ownership rights in the App or the content you access through the App. Except as expressly permitted in these Terms, you may not copy, modify, distribute, sell, or lease any part of our App or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions.
4. Disclaimer of Warranties
You expressly acknowledge and agree that your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, the App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. No advice or information, whether oral or written, obtained by you from us or through the App will create any warranty not expressly stated herein.
5. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall KeyForce, its affiliates, directors, employees, agents, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the App. Under no circumstances will KeyForce be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the App or your account or the information contained therein.
6. Changes to the Terms
We reserve the right to modify or replace these Terms at any time, at our sole discretion. We will provide notice of such changes by updating the date at the top of these Terms or by sending you notice through the App or via email. Your continued use of the App after any changes to the Terms are posted will be considered acceptance of those changes.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the country in which the App is available and downloaded by the user, without giving effect to any principles of conflicts of law.
